    Art Rogers took a picture of a man and woman holding puppies.The photograph was used in greeting cards and other merchandise. years later artist Jeff Koons, used the photograph to make a group of statues which he sold for a lot of money. The only difference between Koons’ statues and Rogers’ photo is the coloring of the statues. The statues were brightly colored and the photograph was in black and white. The court ruled that the works of art were too similar and that a average person could see the statues were a copy of the photo. The court also said that Koons should have used a more generic photo to copy and not such a well known one.
